Times to remember   

The Department of Home affair and the Australian Government have made numerous changes and variation in the visa panorama lately. Some of them are already active, while some will become effective from the 1st of July 2022. All of these changes and variations are vital to answer the shortage of staff in Australia at the moment and to boost the economy of the Country.  

In this article we are going to talk about Working Holiday VisaStudent VisaPost Graduate visa and sponsor visa. Let’s see them in details

 

|Working Holiday Visa – subclass 417

Working Holiday Visa is a popular visa, for many the first choice when it comes to coming to Australia. This visa allows eligible passport to come to Australia, working and travelling while in the country. The age limit for most of the passports, for instance the Italian one,  is 31 years of age (but not turned 31). 

From 1st July 2022 the limit for Italian passport holders will be 36 years of age (but not turned 36). 

Another relevant variation made to this visa from 19th of January 2022 is that, WHV holder can work for more than 6 months with the same employer, in every sector of the economy. This arrangement will be review in December 2022. 

Furthermore on 19th January 2022, the Government has announced that eligible WHMs can ask for a refund of their visa application charge. To be eligible the WHMs must have arrived in Australia between 19 January 2022 and 19 April 2022 and can submit the request if in Australia until 31 December 2022.

|Student Visa – subclass 500

The Department of Home Affair have made a significant variations with this visa. The two areas affected are:

  • working rights 
  • commencement of the course 

Working Rights

In normal times, the primary student visa holder (subclass 500) can to work maximum for 40 hours fortnightly, however when the course is not active he can work full time. On the other hand, the secondary applicant can only to work 40 hours fortnightly ALWAYS, independently of the status of the course. 

From 19th January 2022, Student visa holders (current and future) have fully working rights, this applies to the secondary applicant too, in every sector of the economy. 

Commencement of the course

In normal times, a student visa holder would have to wait the commencement of the course in order to be able to work.

From 19th of January, this has changed giving the applicants the right to start working from the fist day they arrive in Australia, even if the course has not commenced yet. 

 

In conclusion, the Government has given the opportunity to apply for a refund of the visa charge also to Student visa holders that have travelled to Australia on that visa between 19 January 2022 and 19 March 2022. Applicants can submit the request if in Australia until 31 December 2022.

|Post Graduate Visa – subclass 485

The changes made to Post Graduate Visa will be active from 1st July 2022 until 30 June 2023. (May Change)

The Department of Home affair along with the Government have given the access to 24 months of Post Graduate visa to student of all VET courses

There are some conditions: 

  • the course/courses must be fully completed and studied in English (English courses don’t apply), CRICOS registered courses only
  • the applicant must have been enrolled in the course/courses for at least 92 weeks
  • the applicant must have completed the course/courses on a Student Visa and not longer than 6 months before
  • IELTS overall 6 and no component below 5 required 

Also, another positive element is that the skill assessment will be no longer required for all 485 applicants.

 

|Sponsor visa – subclass 457 and 482

On 18 March 2022 the Australian Government has introduced a new legislation. This will allow 482 visa holder sponsored in the short term list – STSOL, to apply for Permanent Residency (PR). This changes will be active from 1 July 2022.

Some conditions apply:

– Must hold 482 visa
– Must have been in Australia for at least 12 months in the period from 01/02/2020 to 14/12/2021
– Still be employed

The pathway to Permanent residency will be accessible via
– 186 visa
– 187 visa

Must be nominated by a suitable employer and will be possible to apply ONLY for nominations under the Temporary Residence Transition stream (TRT).
